GENERAL TERMS AND CONDITIONS FOR BOOKING AN EXPERIENCE

I. Definitions

Operator: Enjoy Group sro, Námestie Š. Moysesa 42/14, 974 01 Banská Bystrica, Company ID: 46 668 659, Tax ID: 2023508234, VAT ID: SK2023508234 operating the NajZazitky.sk portal

Buyer: A natural or legal person shopping on the NajZazitky.sk website.

Voucher holder: the person who purchased the Experience in the form of an Experience Voucher, or the person to whom the Experience Voucher was gifted

Service Provider: the entity offering the Experience through the Operator's portal. The Service Provider is responsible for the implementation of the Experience.

Experience Voucher: is a voucher for an Experience with a unique code, security code and validity entitling the Voucher Holder to use the Experience at the Provider specified in this voucher. An integral part of the Experience Voucher are the attached information and conditions for the implementation of the Experience, which the Voucher Holder is obliged to comply with.

Experience: a service offered by the Provider through the portal NajZazitky.sk. The Experience contains the specification of the service, the price and the terms of use of the service. After ordering the Experience, the Operator will issue the Buyer an Experience voucher for its completion with the Provider.

II. Relationship between the Operator and the Buyer or Voucher Holder

The Operator does not enter into a contractual relationship between the Voucher Holder and the Provider.

The Operator is only an intermediary of the Experience and does not sell or provide the services in question.

III. Responsibility of the Operator and Provider

The Provider is fully responsible for the performance of the Experience according to its specifications at the time of ordering the Experience, as well as for its quality and scope and the fulfillment of all rights of the Voucher Holder related to the use of the Experience. The Provider is also responsible for the accuracy of information about the Experience and its price(s) that the Operator states on the NajZazitky.sk website.

The voucher holder acknowledges that the Operator is not responsible for the fulfillment of the Experience.

The Operator is not responsible for any damages incurred in connection with the use of the Experience with the Provider.

The voucher holder is therefore obliged to exercise his rights and obligations arising from the implementation of the Experience with the Provider.

IV. Rights and obligations of the contracting parties

The Voucher Holder may allow a third party to redeem the Experience Voucher. The Voucher Holder is obliged to inform the Service Provider of this fact well in advance of the Experience. In such a case, the Voucher Holder loses the right to redeem the Experience and this right passes to the authorized third party.

V. Booking a date for the Experience

The Experience can be realized based on a completed reservation form. Reservation and realization of the Experience is possible only within the validity period of the Experience Voucher.

A binding reservation can be changed no later than 14 days before the date of implementation, unless otherwise agreed.

The Service Provider is entitled to change the date of the binding reservation due to adverse weather conditions for the implementation of the Experience, technical reasons or other unforeseen circumstances that may disrupt the safety and feasibility of the Experience. In such a case, the Voucher Holder is entitled to complete the Experience on an alternative date. The Voucher Holder is not entitled to compensation or reimbursement of incurred costs and damages.

If the Voucher Holder was interested in reserving a date during the period specified on the accompanying letter, but the actual realization was not possible for technical reasons until the expiration of the Experience Voucher, the Voucher Holder is entitled to a free extension of the voucher's validity.

VI. Realization of the Experience

The voucher holder is obliged to arrive at the Experience venue on the agreed date and time.

The Voucher Holder will present the Experience Voucher on site, which he/she will hand over to the Service Provider or, if applicable, to a person authorized by him/her. Based on the submitted Experience Voucher, the Voucher Holder will be allowed to complete the Experience.

If the Voucher Holder or other persons present with him/her before or during the Experience do not comply with the conditions specified in the description of the Experience, do not follow the instructions of the instructors or other responsible persons authorized by the Service Provider, or are under the influence of alcohol or other intoxicating substances, the Service Provider is entitled to cancel or interrupt the implementation of the Experience without the right to complete the Experience on an alternative date or to compensate for the costs and damages incurred.

In the event that the Voucher Holder fails to appear at the Experience venue on the agreed date and time, the Voucher Holder is not entitled to complete the Experience on an alternative date or to compensation for incurred costs and damages.

VII. Voucher validity

The validity of the Experience Voucher is 12 months from the date of issue, unless otherwise stated or agreed. The validity is stated on the Experience Voucher.

The validity of the Experience Voucher is fixed and cannot be extended unless otherwise agreed. If not used within the validity period, the Buyer or Voucher Holder is not entitled to a refund for unused services.

VIII. Complaints

In the event that the Service Provider has not provided the Voucher Holder with the Experience specified on the Experience Voucher, the Voucher Holder is entitled to complain about the Experience, or its unprovided part, to the Experience Provider immediately, no later than 14 calendar days from the discovery of the defect.

The voucher holder is obliged to provide a detailed description of the claimed Experience, or part thereof, and the voucher code to which the claim relates in the complaint.

If the complaint is not resolved by the Service Provider, the Voucher Holder may contact the Operator, who will provide maximum assistance in resolving the complaint.

IX. Privacy

The Buyer or the Holder of the voucher, pursuant to Act No. 122/2013 Coll. on the protection of personal data and on amendments and supplements to certain acts, as amended, provides the Operator and the Provider with personal data specified in the order form (i.e. name, surname, address, phone number and e-mail) voluntarily and freely. The personal data will be used by the Operator and the Provider for the purposes of redeeming the Experience.

The Buyer or the Holder of the Voucher is aware that the Operator processes personal data on behalf of the Provider for the purpose of redeeming the ordered experience based on the provisions of Section 4, paragraph 2, letter d) of the Personal Data Protection Act. The Buyer or the Holder of the Voucher hereby agrees to the provision and disclosure of personal data for the above purposes. The Buyer or the Holder of the Voucher is aware that the Experience cannot be performed without this consent.

The Buyer or the Holder of the Voucher agrees to the inclusion of the Provider's verbal evaluation on the Operator's website, which the Buyer or the Holder of the Voucher has included on the NajZazitky.sk website or the application associated with the website. In the event of using a photograph for a verbal evaluation, the Buyer or the Holder of the Voucher grants a time- and geographically unlimited license without compensation to use the photograph by the Operators or Providers for the purpose of presentation, marketing or advertising purposes. If there are other persons in the photograph in question, the Buyer or the Holder of the Voucher is obliged to ensure the consent to use the work of all these persons. The Operator shall not be liable for any violation of this obligation.

The buyer or the voucher holder has the right to request the withdrawal of the consents specified in this article of the contract at any time in writing or by e-mail.

X. Final provisions

These terms and conditions are valid from the date of their approval by the Buyer, unless otherwise agreed in writing.
